Adebayor <Togo player> causes more trouble in South Africa

Togo striker Emmanuel Adebayor is reportedly causing trouble in South Africa despite his teams ouster from the tournament. The Togo team had been staying at the plush Winkler Hotel in Mpumalanga.

After getting knocked out of the Africa Cup of Nations they had a flight booked to take them back to Togo but Adebayor told some of the squad not to take it because he was going to arrange a private jet for everyone.

The players therefore didnt check out and the hotel was unable to check people in who had rooms books for the night. The squad were supposed to leave on Monday but a source said Some players were in the parking lot (of the Protea The Winkler Hotel) when I arrived. CAF did nothing wrong.

They informed the team in advance that if they lost they would leave the next day, but the team is still there at the hotel.Togo were supposed to leave with the plane that dropped Ghana on Monday, but I was told that Adebayor asked the players to stay because they were going to take a private jet home.

Instead of going to Johannesburg first they would fly straight home. The private jet didnt arrive and in the end the players are now stuck.

See How Wizkid & Banky Turned Against Each Other

The split between Banky W and Wizkid, inside sources say, resulted from an alleged high difference in what Banky W gets from revenues made by the young star, Wizkid. The 'injustice', according to what TON gathered, has been bothering Wizkid until he summoned the courage to ask for an improved contract from Banky W, which hit him (Banky) by surprise.

"You know Wizkid is the backbone of EME music label. The boy (Wizkid) feels that Banky W has been milking too much from him with the large chunk of what Banky W takes from what the boy makes."Wizkid has asked for an improved contract because the present one allocates much of Wizkid’s earnings to Banky W.

You know when you are coming up, you sign any kind of deal because you just want to climb stardom. "That is the situation the boy finds himself but Banky felt hurt that Wizkid could ask for an improved offer after what he (Banky W) has done for him."This was the beginning of the problem between them.

The boy even threatened to leave the label sometimes ago but Banky W felt it was a joke. He took it with a pinch of salt. Now, he is at a crossroad and confused on what to do," a source told Aproko 247

.Wizkid's mum waded into the matter but Wizkid reportedly ignored his mum advice and stood his ground on leaving the label. "Wizkid’s mum has also tried to talk sense to her son but it seems the guy (Wizkid) is bent on moving on with his life."

Parading the suspects yesterday, at the police headquarters in Lokoja, the state Commissioner of Police, Mohammed Musa Katsina, described the arrested suspects as a sledgehammer robbery gang.

The Assistant Pastor of the church, Pastor Aloysius Momoh, who expressed surprise at the youth leader’s involvement in the crime, said that the church went into seven-day prayer and fasting shortly after the church was robbed, and God warned those behind the dastardly act to repent between May and December, last year, or be disgraced One of the victims, Paul Ikunagus, said over N2 million cash was stolen from his shop while one of them said he lost N5.8 million to the robbers who invaded his shop last December.

Justice Abang Went Beyond Our Brief, Says Ifeanyi Uba’s Lawyer

The legal tussle between the Managing Director of Capital Oil and Gas Limited, Mr. Ifeanyi Uba, on the one hand, and Access Bank and Coscharis Motors Limited, on the other, has taken a new dimension.Michael Swainston, Ifeanyi Uba’s London lawyer, claimed Justice Okon Abang of the Federal High Court, Abuja went beyond the brief of his client.

Justice Abang had on Friday ordered Access Bank Plc to withdraw within 48 hours all court processes filed before a London court against Uba.The judge had also ordered that the court order obtained by Access Bank should not be enforced in Nigeria, saying the action had ridiculed the country’s judiciary. But Uba’s lawyer, Swainston, in a statement containing his argument to Mr. Justice Popplewell of London High Court of Justice, Queen’s Bench Division, on pages 205-208, paragraph 2-5 said the following about Justice Abang’s order:“On 28 January, 2012, the Nigerian Court made various orders.

Counsel for Capital Oil and Mr. Ifeanyi Uba sought preventive orders of Justice Abang to stop the London court process, in other words to maintain status quo. We are instructed that the judge went beyond the prayers of Ifeanyi Uba's motion finding criminal contempt because of Capital Oil’s evidence in England, which in his (Justice Abang) views scandalised the Nigerian courts.”

Justice Abang had condemned Access Bank Plc and Coscharis Motors Ltd for undermining Nigeria's judiciary by obtaining an order from a London Court, which violates an existing order of the Nigeria court.
What Justice Abang did not disclose was that Access Bank and Coscharis Motors went to the London Court to seek justice well before Ifeanyi Uba and Capital Oil took their case to Justice Abang’s court.
Justice Abang had ruled based on the argument canvassed by Chief Wole Olanipekun (SAN), leading another Senior Advocate of Nigeria (SAN), Lawal Rabana and 16 other lawyers on behalf of the plaintiffs. The hearing of the substantive suit was adjourned till February 4.The London High Court of Justice, Queen’s Bench Division, had placed a worldwide order (Mareva injunction) against the assets of Uba and his company, Capital Oil and Gas Industries Limited in November last year.

The order by the UK court, which was granted sequel to an application by Access Bank Plc, was aimed at preserving the assets of the respondents pending the determination of the suit brought before it by the bank. The bank had alleged that Uba and his company had fraudulently diverted the petroleum products it financed under the joint venture agreement between Capital Oil and Coscharis Motors Limited.

Also restrained alongside Uba and Capital Oil and Gas Industries Limited, were Rofos Navigation Limited, Xifias Navigation Limited, Heli Navigation Limited and Tutbury Maritime Limited. In November last year, a Federal High Court sitting in Lagos had restrained Access Bank Plc and Coscharis Motors Ltd from interfering with properties belonging to Capital Oil and Gas Ltd and its CEO, Uba, pending the determination of a suit filed by the plaintiffs.Ubah and his company had challenged the worldwide order (mareva injunction) by the English court on November 9 last year, freezing assets worth $133.5 million belonging to the party in England and Wales.

This order was said to be contrary to an order made by the Lagos High Court, reportedly issued on the same day, restraining the other party from “interfering with the applicants’ properties and/or business interest, pending the final determination of this suit.Uba was arrested and detained by the police in connection with a N43 billion fuel subsidy fraud by the order of a Magistrate court sitting in Lagos.

He was later released. He was said to have committed the offences of economic sabotage, obtaining money by false pretence, stealing of N43.291 billion, property of the Federal Republic of Nigeria, money-laundering and forgery.

Appeal court affirms death sentence on Rev. King

The Court of Appeal sitting in Lagos, yesterday, affirmed the death sentence passed on the General Overseer of the Christian Praying Assembly, Rev. Chukwuemeka Ezeugo, a.k.a Reverend King by Justice Joseph Oyewole of the Lagos State High Court;I hereby rule that the prosecution effectively discharged the burden of proof on it.

This appeal is devoid of any basis and accordingly fails.General Overseer of the Christian Praying Assembly, Rev. Chukwuemeka Ezeugo, a.k.a Reverend KingThe judgment of the High Court is hereby affirmed, and the conviction imposed on the appellant, (which is death by hanging) is also affirmed; Justice Fatimo Akinbami who read the judgement held.

two other members of the panel of Justices, Amina Augie and Ibrahim Saulawa concurred with the lead judgement.Ezeugo was sentenced to death by the Lagos State High Court, Ikeja, on January 11, 2007 for the murder of one of his church members, Ann Uzoh.Ezeugo was arraigned on September 26, 2006 on a six-count charge of attempted murder and murder but he pleaded not guilty to all the charges.
The prosecutor had said that the convict poured petrol on the deceased and five other persons and that Uzoh died on August 2, 2006; 11 days after the act was perpetrated on her.
Counsel to Ezeugo had filed a notice of appeal on January 16, 2007, containing 16 grounds of appeal against the judgment. On June 10, 2008, the Court of Appeal granted him leave to argue the additional 16 grounds of appeal through an amended notice of appeal filed on June 15, 2008.Rev. King's Counsel, Mr Olalekan Ojo however criticised yesterday's judgement, saying that his client will appeal the decision at the Supreme Court, as according to him, the judgment did not meet the expectation of the appellant.

In a unanimous judgement read by Justice Akinbami, the Appeal Court dismissed the appellant's claim that the case of the prosecution was clustered with doubt and held that all the issues raised by the appellant failed, and resolved same in favour of the prosecution.
On the issue of dying declaration by Miss Uzoh, the Justice Akinbami said that there must be the belief in the danger of approaching death, and this belief is subjective rather objective and upheld the view of the lower court and held that the declaration of the deceased cannot be admitted as a dying declaration, since there was no immediate apprehension or fear of approaching death.
On the defence of alibi raised by appellant counsel, Justice Akinbami ruled that the evidences adduced by prosecution witness 1, 2, 3, 4, 9 and 10, clearly pinned the appellant to the scene of the crime. She said,The import of alibi is to show that the accused was elsewhere other than the purported place of crime.
It is the duty of prosecution to investigate such claims, adding that in the case of State vs Fatai Azeez, the evidence of the prosecution witnesses linked the appellant to the scene of the offence.
According to Justice Akinbami, “even the evidence of a tainted witness is admissible once it is material to the case. A tainted witness is one who may not be an accomplice, but whose evidence may be admissible without the necessity of administering any special warning.

The prosecution witness in this case is an eye witness and so the evidence is material to the case.Justice Akinbami further held that all evidence adduced by the prosecution witnesses, were unanimous, saying that they all pointed to the fact that the appellant actually used matches and petrol to set the deceased ablaze.

Each of the prosecution witness gave evidence as to how the victim was beaten and burnt by the appellant. To my mind, there is no contradiction whatsoever and even if there were, it is immaterial, since all the witnesses are unanimous On the style used by the lower court in arriving at its judgement, the appelate court said the trial judge was at liberty to write his judgment in his own style, provided he/she set out the issue for determination, thus showing a clear understanding of the facts as stated. While pointing out that the evidence adduced especially by Pw 6, who performed the post mortem examination, revealing that the deceased died as a result of loss of fluid arising from the burning, Justice Akinbami said that the evidence of Pw 5, 8, 6 and 7, (doctors) all showed that the deceased died as a result of the burns.

The judge stressed that the evidence of pw 2, who was the Investigating Police Officer, IPO, also revealed the items used in carrying out the dastardly act on the victim pointing out that the burden of proof in a criminal trial lied on the prosecution, and this was done beyond reasonable doubt.
Proof does not mean proof beyond scientific certainty or beyond any shadow of doubt, but only beyond reasonable doubt, the Judge added.
Condemning the attitude of some pastors towards their congregation, the judge said that the circumstance surrounding the death of the deceased was so bizarre, adding the ingredient of this case is so bizarre. It is so devastating how some men of God will give out to their congregation, scorpion instead of fish, and stone instead of bread.
It is indeed sad and unfortunate. However, Director of Public Prosecution, DPP, Mrs. Olabisi Odugbesan, said there was no miscarriage of justice and that all the grounds for the appeal were misconstrued. We are very pleased that justice has been done today. We know that the judgment will serve as deterrent to future and incident of this nature by church leaders that abuse and exploit their followers.
